2. Applicability

These Terms & Conditions apply to consumers who order products through the BY INADA online store. A consumer is a person acting for purposes outside their trade, business or profession.

You can read and save these Terms & Conditions before placing an order. The version that applies to your order is the version that was in effect when you placed the order. Subsequent changes do not affect existing agreements.

Mandatory statutory consumer rights always remain applicable.

3. Products and Offers

We describe our products as clearly and accurately as possible. Before purchasing, please read the product information, ingredients, instructions for use and warnings.

Minor colour differences may occur due to screen settings. This does not affect your right to receive a product that conforms to the agreement.

Obvious errors, such as a price that you could reasonably understand to be incorrect, are not binding on us. If we identify such an error in your order, we will contact you. Any amount already paid for an order that cannot proceed as a result will be refunded.

4. Orders and Formation of the Agreement

The agreement is concluded when you place your order and receive our electronic order confirmation.

Please check your details before placing your order. If you notice an error, contact us as soon as possible at info@byinada.nl. We will try to make the necessary correction, but cannot guarantee that changes can be made once the order is being processed or has been shipped. Your statutory rights remain unaffected.

You will receive an order confirmation by email. An account is only required if this is indicated during the ordering process.

5. Prices and Payment

All consumer prices displayed in our online store are in euros and include the applicable VAT.

Any shipping costs and other mandatory charges will be shown before you complete your order. You will see the total amount payable before confirming the order with an obligation to pay.

The available payment methods are displayed during checkout. Payments may be processed by a payment service provider, such as Mollie.

Price changes made after you have placed your order do not affect the agreed price.

6. Shipping and Delivery

We deliver to the countries available for selection during checkout. Available delivery options, shipping costs and estimated delivery times are stated in our Shipping Policy and are shown before purchase.

We will deliver within the agreed period. If no other delivery period has been agreed, we will deliver no later than 30 days after the agreement has been concluded.

If there is a delay, we will inform you. If we fail to deliver on time, you may, where required by law, give us a reasonable additional period in which to deliver. If we also fail to deliver within that additional period, you may terminate the agreement. Where permitted by law, you may terminate the agreement immediately without providing an additional period. Following termination, we will refund any amounts due without undue delay.

The risk of loss or damage remains with BY INADA until you, or a person designated by you who is not the carrier, receive the products. The statutory exception applies if you independently appoint a carrier that was not offered by us.

Our supplier may ship orders directly to you. BY INADA remains your point of contact and remains responsible for fulfilling the purchase agreement.

7. Right of Withdrawal and Returns

You have the right to withdraw from your purchase without giving any reason within 14 days from the day you receive the products. If products from a single order are delivered separately, this period starts from the day you receive the final item.

You must notify us of your decision to withdraw within this period by emailing info@byinada.nl or by sending a clear statement to our correspondence address. A model withdrawal form is included in our Return & Refund Policy. Use of this form is not mandatory.

After notifying us of your withdrawal, you have a further 14 days to return the products.

The direct cost of returning products is your responsibility when exercising your right of withdrawal because you have changed your mind. For damaged, defective or incorrectly delivered products, necessary return costs will be borne by BY INADA.

Please handle the products with care. You are only liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the products.

For products that are actually sealed and are not suitable for return for health protection or hygiene reasons, the right of withdrawal may cease to apply if the seal is broken after delivery. This applies only where the statutory exception applies and you have been informed of this before purchase.

We will issue a refund within 14 days after receiving your notice of withdrawal. We may withhold the refund until we have received the returned products or until you provide evidence that you have returned them, whichever occurs first.

If you withdraw from the entire order, we will also refund the original standard delivery costs. Additional costs resulting from choosing a more expensive delivery option will not be refunded. If you return only part of an order, the original delivery costs will not be refunded.

Refunds will be made using the original payment method unless you expressly agree to another method. We will not charge any fees for the refund.

8. Statutory Guarantee

You are entitled to receive products that conform to the agreement and have the qualities that you may reasonably expect.

If a product is damaged, defective, incorrectly delivered or otherwise does not conform to the agreement, please contact us at info@byinada.nl. We will provide an appropriate remedy free of charge in accordance with applicable law, such as replacement or repair and, where you are legally entitled to it, a price reduction or refund.

Any manufacturer's warranty is in addition to your statutory rights. BY INADA remains your point of contact.

9. Use of Haircare Products

Use products in accordance with the instructions provided on the packaging and product page. Please take note of the listed ingredients, warnings, shelf life and storage instructions.

Discontinue use if irritation occurs. If symptoms persist, consult a medical professional. Our product information does not constitute medical advice. These instructions do not limit your statutory rights.

10. Complaints

Please send complaints to info@byinada.nl, preferably including your order number and a description of the issue.

We will respond no later than 14 days after receiving your complaint. If more time is required to handle your complaint, you will receive an acknowledgement within this period together with an indication of when you can expect a substantive response.

If we are unable to resolve the matter together, you may submit the dispute to the competent court.

11. Liability

BY INADA's liability is governed by applicable law. These Terms & Conditions do not exclude any liability that cannot legally be excluded and do not limit any mandatory consumer rights.

12. Privacy and Shopify

We process personal data as described in our Privacy Policy.

Our online store is hosted by Shopify. Your purchase agreement is concluded with BY INADA. Shopify is not the seller and is not a party to the purchase agreement.

13. Intellectual Property and Use of the Website

Rights relating to our name, logos, texts, images and other website content belong to BY INADA or the respective rights holders.

Do not use this content without permission, except where permitted by law. You may save information relating to your own purchase and these Terms & Conditions for personal use.

Misuse of the website, fraud and interference with the security of the website are prohibited.

14. Governing Law

These Terms & Conditions and agreements are governed by Dutch law.

If you are a consumer residing in another country to which we direct our sales activities, you also retain the protection provided by the mandatory consumer protection laws of your country of residence.

Disputes will be dealt with by the court having jurisdiction under the applicable legal rules.
